Sam was charged with drunk in public under penal code 647f. A drunk in public has a high standard of proof required. In order for the prosecution to prove a person was drunk in public they need to show that the person was so impaired that they were either a danger to themselves or a danger to others. A quick example might be somebody that’s falling down drunk, vomiting in the gutter, and a danger to others might be somebody that is so impaired there out in the street walking in front of cars. So on Sam’s case he was charged with drunk in public after he was walking in the streets and he happen to have alcohol in his body. Long story short case dismissed.
