Can I reduce a felony Dui to a misdemeanor?

Hello this is Attorney Patrick Silva with another answer to one of your frequently asked questions. Recently I was asked I had a felony Dui approximately 2008 can I get it reduced to a misdemeanor? The process of get a felony dui reduced to a misdemeanor is know as penal code 17b it allows you to reduce it from a felony down to a misdemeanor. After you have been successful at that time then you can move it from a misdemeanor down to expungement. Which in essence says, I am pulling back my guilty plea and entering a not guilty plea and the courts wiping it clean. So the short answer is yes it all depends on the facts of the case, did you complete your probation, have you had any other Dui’s since then, have you had any trouble in the law. Normally it can be accomplished, seek out an expungement lawyer someone who practices in that local court house and who practices expungement law. This is Attorney Patrick Silva, Have a Nice Day.
