Q. What is the statue of limitations on an underage dui in California?

The district attorney has not filed charges as of yet and it's going to be 5 years ago soon. The incident is no longer in their system. I called the D.A. and couldn't get any useful information however I recieved a letter stating they weren't going to file charges as of yet and to seek legal counsel regarding statue of limitations.


​​1 year from the date of arrest....It would seem you are not going to be prosecuted for the DUI due to the passage of time. The S.O.L. for a misdemeanor Dui is one year and three year for a felony DUI. But if you still aren't sure you can always talk to a lawyer for free.
